The Client warrants that all information provided in the account application form completed by him/her is and shall remain true and correct. The Client undertakes forthwith, and in writing, to advise Bettabets of all matters or changes that are material to the Client’s’ creditworthiness, legal capacity, or continued eligibility as a Client. Bettabets – reserves the right to – accept an application for a new betting account. reject an application for a new betting account for any reason whatsoever. cease accepting bets from a Client in its sole discretion for any reason whatsoever, which reason Bettabets shall not be obliged to provide or disclose to the Client or any other person, should such a bet be non-compliant with, but not limited to the relevant gambling laws, the Terms, pay-out limits, the Financial Intelligence Centre Act (Act 38 of 2001 as amended)(hereinafter referred to as FICA). shall reject an application for a new account if – the betting account application form has not been completed in full, and/or the information included in the betting account application form is found to be inaccurate or subject to a material omission, and/or any information required to be submitted in conjunction with the application form, or requested by Bettabets prior or after the submission of the application form is not provided by the Client in the manner or format and/or within such timeframes as Bettabets may stipulate. The Client shall be solely responsible for the safekeeping and proper use of all his/her betting account details and other information that will enable him/her to place a bet. The Client undertakes that he/she shall – not apply for or retain more than one betting account with Bettabets. not apply for an account in the name of or on behalf of any other person, and not permit or allow any other person to place a bet, directly or indirectly, by making use of such betting account reference number, username or personal identification number as is or may be furnished to the Client by Bettabets from time to time, Bettabets shall not be liable to honour any transaction pertaining to any account so held for or to pay out any winnings in respect of any bet so placed, in breach of the aforesaid undertakings. The Client undertakes to notify Bettabets immediately if the Client’s account information is lost, stolen, misappropriated, or used by someone other than the Client or the Client has reason to believe that any of these circumstances has occurred. Once a business relationship has been established with a Client, a betting account will be created in the name of the Client and the Client will be required to log into his/her Bettabets betting account for the purpose of entering into betting transactions with Bettabets, using his/her custom-made login details, including a dedicated username and password. If there is any variance between the information entered by a Client at the time of logging into his/her betting account, and the information supplied to Bettabets by the Client at the time of starting the business relationship, the Client will not gain access to his/her account and will be required to contact Bettabets for support. Fraudulent Activity Check By accepting BettaBets Terms and Conditions on registration, customers acknowledge that we may conduct a fraud check on your profile at our own discretion. If BettaBets suspects fraudulent activity in relation to any account or bet, Betta Bets reserves the right to suspend the account and the processing of all transactions on that account until Betta bets is satisfied that the transactions concerned are lawful. Betta bets will report any fraudulent activities to the relevant authority. FICA Compliance 3. FICA Compliance Bettabets is bound by the provisions of the FICA, which sets out the requirements in relation to identity establishment and verification procedures, the recording and ongoing monitoring of transactions, the maintenance of records and related matters. All these requirements have been put in place in order to ensure that the betting services offered by Bettabets, are not illegally used as vehicles for money laundering and/or the financing of terrorism or other criminal activities. Where FICA or its associated regulations and instruments specify such procedures and/or restrictions, then Bettabets will operate in accordance with such procedures and/or restrictions. Where FICA does not specify such procedures and/or restrictions, then Bettabets shall implement its own procedures and/or restrictions (subject always to any applicable legislation), to promote good corporate governance and socially responsible betting practices. No betting account will be created unless the identity of the Client who applied for same, has been conclusively established and verified by Bettabets. Bettabets will not accept or verify any account with an Asylum Seeker’s Permit or Refugee Permit as means of Identity. The following procedures will be followed by Bettabets in relation to a Client in respect of whom proof of identification and residential address is required: Where a Client presents his or her identification document (ID or passport) in person, Bettabets shall make a photocopy of such document at Bettabets branches and verify that same is a true copy of the original, which shall be filed and retained for record purposes. Where an identification document is transmitted to Bettabets via scans or by electronic mail, such documents will be required to be current (unexpired in the case of passports) and, if required by Bettabets, to be certified as true copies of the original. A driver’s licence may, at the sole discretion of Bettabets, be accepted as proof of identification, provided that: The Client is unable to produce an Identity Document for reasons which are acceptable to Bettabets in the circumstances. The driver’s licence is valid/current (has not expired), and The driver’s licence reflects on the face thereof – A photograph of the holder. The full names or initials and surname of the holder. The date of birth of the holder, and The Identity Number of the holder. Utility bills and similar documents submitted as proof of residential address shall be dated no earlier than three (3) months prior to the date of submission to Bettabets. By completing the Bettabets online betting account registration form, the Client authorises and irrevocably consents that Bettabets shall be entitled to conduct such identification, credit, and other authentication and/or screening or security checks (including, but not limited to, verifying the Client’s source of funds) that Bettabets may choose to perform and/or is required to perform in terms of the applicable laws. The Client consents that as part of the registration process, and at any time during the period for which the Client may be the holder of a betting account with Bettabets that Bettabets may supply the identifying details and any related particulars provided by the Client to third-party service providers, including, without limitation, identity verification and/or screening agencies, cellular network providers, financial institutions, credit bureaux and/or any other national and/or provincial governmental agencies or statutory bodies. Bettabets will respect the privacy of the Client’s personal information and shall take all reasonable steps to protect the personal information of the Client; provided that Bettabets will not be liable for any loss of data by itself or by any other contracted service providers relied upon. For the purposes of this clause ‘personal information’ shall be defined as detailed in the Protection of Personal Information Act No.4 2013 (POPI). The POPI Act may be downloaded from here. In the event that the Client fails to provide Bettabets with the requisite documentation/information Bettabets shall suspend the betting account until such time as the documentation/information is provided to the satisfaction of Bettabets, or the permanent termination of the betting account, if the Client neglects or refuses to provide the relevant information. Bettabets is required to report single cash transactions above R24,999.99 to the Financial Intelligence Centre (“FIC”) in compliance with the provisions of FICA. Bettabets is further obliged to make reports to FIC in the event of – suspicious or unusual transactions, and transactions entered by persons suspected of intending to commit or of having committed any offence contemplated in the Protection of Constitutional Democracy against Terrorist and Related Activities Act, 2004. Betting Markets & Limits Bettabets shall, in its sole discretion, determine the markets, events or contingencies on which betting shall be offered by it; provided that – Multiple bets are not accepted where the outcome of one part of the bet contributes towards the outcome of another. If the Client inadvertently or intentionally backs a related contingency in a multiple bet, the bet will be void and the stake returned; Any multiple stake made up of more than one selection from the same event will be deemed to be a related contingency, e.g. Bulls to win the semi-final onto Bulls to win the Tournament, and Any multiples involving the same team or its players or the same selection will be deemed to be a related contingency e.g., Siya Kolisi to be Man of the Match and South Africa to win the match. Bettabets may from time to time determine a minimum or maximum amount that may be staked as a bet in respect of any market, whether in general or in any given case. It shall be the responsibility of the Client to determine before placing a bet on a market whether such maximum or minimum is applicable to that market and, if so, the extent thereof. Bettabets may determine minimum or maximum amounts that a Client may win or lose in respect of a bet (“stop wins” and “stop losses”), whether in general or in any given case. It shall be the responsibility of the Client to enquire before placing a bet on a market as to whether such maximum or minimum is applicable to that market and, if so, the extent thereof. Bettabets may, in its sole discretion, from time to time offer the opportunity to the Client to place bets during a certain event (“bets in-running”), provided that – Bettabets may not accept bets in-running in respect of an event that forms part of a series of events over a period, and if the relevant event is not televised, no bets in-running shall be offered, except at the election of Bettabets. Betting Procedures & Rules The Client shall place his/her bets via the internet, or if using the mobile betting platform, per telephone via the telephone number furnished by Bettabets from time to time or through such other electronic media as may be made available by Bettabets. Irrespective of the origin or physical location of any telephone call or electronic signal pursuant to which bets are struck, any betting transaction between Bettabets and the Client shall be valid only once such bet has been accepted by an employee of Bettabets situated at any licensed premises operated by Bettabets, or electronically by a software programme operated from any such premises and/or hosted at any other secure remote location determined by Bettabets. Any such bet will be deemed to have been placed at such licensed premises. Bettabets may in its sole discretion elect whether to accept or to reject a bet requested, or any selection thereof. The Client authorizes and gives permission to each telephone conversation or electronic communication relating to any bet placed being recorded by Bettabets in such method as Bettabets deems fit and to retain such records as long as Bettabets deems necessary. The Client acknowledges that Bettabets is required to keep such records by law and that such records may be used by Bettabets for the investigation and outcome of disputes which may arise between itself and the Client or for any other lawful purpose. The Client shall bear the responsibility of ensuring that the bet is correctly placed and recorded by Bettabets. Bettabets shall furnish such confirmation of a bet to the Client as may be required by law or reasonably requested by the Client. Bettabets shall accept bets during normal South African business hours and at such other times as Bettabets may consider fit. The Client shall be liable for ensuring that he/she has full knowledge of the rules related to the market within which the Client proposes to place a bet. The laying of a bet indicates the Client’s acceptance of the Rules published by Bettabets in respect thereof and of the Terms. Whilst Bettabets will attempt to ensure complete accuracy in relation to the announcement, publication and issue of prices, off-times (starting times of events) and results, it does not accept accountability for any errors which may arise in this regard and reserves the right to correct any such errors in such manner as it may determine in its sole discretion. The Client indemnifies and holds Bettabets harmless in respect of any losses, whether potential or actual and direct or indirect, which may be suffered in consequence of any such error. Any bet alleged to have been placed in respect of which the details are not – recorded on or reflected by Bettabets betting terminals or wagering software, or where applicable, confirmed by voice recording devices, will not be recognized by Bettabets. The time of acceptance of a bet shall be the time at which such bet was recorded on Bettabets betting terminals and/or wagering software. Any bet accepted after the “off” or starting time of the event on which, such bet is struck (other than bets in-running) shall be void and cancelled. Deposit Information & Methods Once a betting account has been established in the name of the Client, the Client may deposit funds into the betting account by – Logging into to his/her account, using the account number and secure password (created and confirmed by the Client as part of the registration process). Selecting the “Deposit” function; Selecting the way the deposit is to be made, whether by way of – Credit or Debit Card; Electronic Funds Transfer (EFT); Payment Vouchers; Subject to Clause 6.2 below, by way of Direct Bank Transfer into any of the banking accounts operated by Bettabets, as detailed on the website, and/or Such other/further deposit and/or account replenishment methods as may be made available to the Client by Bettabets from time to time, and in the case of deposits made by the methods referred to in a or b above, by filling the fields with the requested identifying information in relation to the account from which the deposit is to be made. In the case of deposits made by way of payment vouchers – The total amount of the payment voucher must be played through in full, and no winnings can be withdrawn from the betting account until this has occurred, and No payment voucher may be redeemed, refunded, or otherwise exchanged for cash at any time. If deposits are made into a Client’s account using the methods contemplated in Clause 6.1(iii) a or b above, and it is identified that the names of the account holder or cardholder do not match the names of the Client, the monies purported to have been deposited will be rerouted to the bank, and Bettabets will suspend the betting account. In such an event, Bettabets will request the Client to provide bank statements and documentary proof of identification, and based on the information obtained from the Client, will determine whether the betting account may be reactivated. If no bank statements are received from the Client in response to such a request by Bettabets, Bettabets will terminate the betting account. The Client acknowledges and agrees that the deposit referred to in Clause 6.1 will be held and applied as security for the discharge by the Client of any amount which may become owing by the Client to Bettabets. The Client shall under no circumstances place a bet or attempt to place any bet the amount of which, calculated together with any other bets then outstanding, exceeds the Client’s available credit balance with Bettabets, being the net amount on deposit with Bettabets (after all adjustments in respect of taxes, winnings, and losses up to the time of placing of the bet). It shall be the Client’s responsibility before placing a bet to determine whether his/her available credit balance will be exceeded by placing a bet. If, owing to a system malfunction or for any other reason, Bettabets accepts a bet in the circumstances referred to in Clause 6.5, it shall be entitled at its election either prior to, during or after the outcome of the event or contingency upon which the bet was placed, to honour the bet or to refund the Client’s stake in respect of the bet without regard to any winnings thereon. Alternatively, Bettabets may limit the size of any stake without notification to the Client, to ensure that the available credit balance is not exceeded. Acceptance by Bettabets of a bet over the available credit balance shall not constitute a waiver of its rights – to collect from the Client all amounts (including losses) arising from any such bet, or to impose the appropriate limits at any later time. Bettabets shall debit the Client’s betting account in respect of bets accepted by Bettabets on an ongoing basis. Credit card deposits may only be made by the cardholder whose name is displayed on the credit card, which must match the name in which the Bettabets betting account is held. The Client shall be entitled to reload any deposit referred to in Clause 6.1 at any time. No interest to the client shall accrue in respect of any monies held in a betting account. No credit may be offered by Bettabets to any Client. Deposit Methods Deposits from account holders can be made via various channels, all of which are set out below in more detail. To guard against money laundering, a client's deposit must be turned over at least once. These deposits will be held by Bettabets and credited to the client’s betting account once the amount has been cleared. Proof of a client’s deposit must be provided by the client, for his/ her account to be credited. If a deposit is not cleared before the event that has been bet on using that deposit, Bettabets will not be held liable for such bets missed as a result thereof. All deposits held by Bettabets will not bear interest. Bettabets will not be held liable should any of the third-party service providers be unavailable at any time. Bettabets reserves the right to add, cancel or withdraw any deposit option or change any of its terms and conditions related thereto at any time and without cause or notice. All account information and transaction records held by Bettabets are housed in a secure data centre and remain confidential. Account Balances & Recovery In the event of a debit balance in the Client’s account owing to the acceptance of a bet more than the credit or deposit limit, the Client shall, within three (3) business days of a written demand by Bettabets for payment of same, pay to Bettabets such amount either – by depositing the relevant amount directly into the banking account of Bettabets, in which event – the Client’s account number with Bettabets must be entered onto the base of the deposit slip; and a copy of the deposit slip must be forwarded to Bettabets by the Client, or by furnishing Bettabets with written permission, in such format as Bettabets shall require, for the recovery by Bettabets of the relevant amount from the Client’s credit card company. 11.1.  For all purposes of the Terms, a certificate signed by any director, and or manager, of Bettabets (whose appointment need not be proved) stating the amount of the Client’s indebtedness to Bettabets, shall be prima facie proof of such indebtedness.

12.1.  All winning bets in respect of horse racing only are subject to taxes and levies imposed by the regulator. Taxes and Levies shall be retained by Bettabets and paid over on behalf of the player.

Breach and Termination 13. Breach and Termination Bettabets shall have the right prior to accepting any bet, temporarily to suspend or permanently to terminate, the furnishing of betting services to a Client without providing any reason. Upon such suspension or termination – Bettabets shall upon the demand of the Client, refund to the Client the balance of any monies held by Bettabets on deposit for the Client, after adjusting for losses, winnings and taxes and once such funds have been cleared into Bettabets banking account; any amounts owing by the Client to Bettabets shall become payable immediately. The Client shall upon written notice to Bettabets be entitled to terminate its contractual relationship with Bettabets at any time after conclusion of any betting transaction placed by the Client and after payment by the Client of all amounts owing by the Client to Bettabets. General Terms & Conditions General Terms & Conditions The address furnished by the Client on the account application form shall serve as his/her domicilium citandi et executandi for all purposes in respect of the Terms. The physical address reflected in respect of Bettabets on its website, as amended from time to time, shall serve as its domicilium citandi et executandi for all purposes in respect of the Terms. The Client shall have the right to change its domicilin by giving two week’s prior written notice to Bettabets of his/her change of address.
